Chloe’s Hand & Heart ("me", "my", or "I") is committed to protecting your personal information in accordance with the Australian Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).
I only collect personal information as necessary and as outlined in my Privacy Policy. This may include your name, address, email, phone number and payment details.
I will never sell your personal data. I may share it with trusted third-party services (e.g. payment processors, delivery providers and Etsy) only where necessary to fulfil orders, provide customer support and improve your experience and only in compliance with Australian law. An overseas recipient that is likely to receive access to customers’ personal information is Etsy Ireland UC and any other country Etsy uses to provide products and services. Etsy also uses third-party providers, business partners, professional advisors, industry authorities, etc. I encourage you to read Etsy’s Terms and Conditions, Privacy Policy and other information provided by Etsy in relation to this.

Ordering & Payments
- All prices are listed in Australian Dollars (AUD) and include GST unless stated otherwise, as required by law.
- Orders are confirmed once the orders are fully processed.
- I invite requests for replicas of a current or sold out product, however, upon request and supply of a canvas painting or small easel artwork, the customer(s) accepts that, since each of these products is handmade, they will not be identical to the current or sold out product.
Shipping & Delivery
- We deliver Australia-wide only, via Australia Post.
- Orders are typically dispatched once a payment transaction is complete and reflected in my payment account, per Esty’s Terms.
- Delivery times may vary depending on location and circumstances beyond my control.
- I am not liable for delays once the parcel is in the hands of the courier (Australia Post).
Product Quality
Due to the painted small easel artwork and canvas paintings being original pieces, there may be slight flaws that are not shown in the photo(s). If the flaws are not specifically identified in the product description(s), it is because they can still be used for their advertised purpose(s) and the flaw(s) are not visible when viewing the product(s) from a normal distance. An example of a flaw is dust that has settled on the product(s) during the drying process.
Any relevant safety warnings will be included in the product descriptions on my Etsy Store and Website.
Returns & Refunds
- I comply with Australian Consumer Law and provide refunds or exchanges for faulty or damaged goods. There are no exchanges for original products when my Esty account and website clearly say there was one in stock and it is sold out. In order for customers to qualify for a refund, they must provide proof that the product is indeed damaged or faulty.
- The product(s) must be returned within seven (7) days.
- The customer is responsible for return postage costs and any loss in value if an item isn’t returned in original condition.
- There are no returns or refunds for change-of-mind.
Intellectual Property
All content on my website, Facebook Page and Esty Store — product photos, descriptions and designs — is the property of Chloe’s Hand & Heart and is protected under Australian copyright laws. You may not reproduce, copy or distribute any content without my written permission.
Limitation of Liability
To the extent permitted by law, I am not liable for any loss or damage resulting from the use of my website, Facebook Page, Etsy Store or products. My liability is limited to the re-supply (if available) or refund of the relevant goods in accordance with Australian Consumer Law.
I will not be liable for any damage to any product that has resulted from any negligent handling by either Australia Post or the customer(s).
User Conduct
You agree not to misuse my website, Facebook Page, Etsy Store or engage in any activity that interferes with their proper functioning. I reserve the right to block users who breach these terms.
Changes to Terms
These Terms and Conditions apply to all present and future products as relevant.
I may update these Terms at any time without notice. The latest version will always be available on my website. By continuing to use my services, you agree to the updated terms.
Governing Law
These Terms are governed by the laws of the Commonwealth (as applicable) and Tasmania, Australia. Any disputes will be handled by the courts of the relevant jurisdiction.
